There are many factors that factor in to determine child support amount.

Child Support is not calculated based off of “well he/she should pay $800 per month because that is what I want”

The child support guidelines must be used in order calculate child support. The guidelines consider the following:

  1. both parents income,
  2. child(ren)’s health insurance,
  3. child care,
  4. uninsured medical/dental,
  5. and over-nights child(ren) spends with each parent.

After this is determined then a proper child support monthly payment amount is calculated. This child support calculation does not include any arrears in the guidelines and the judge/court will establish those amounts.

We have had some clients request the court to allow them to mutually agree to an amount and there has been times the court approved their mutual written agreement.
