Osceola County, Florida

As per the courts website on 10/07/2016, the following is a summary of the filing procedure:

For a Simplified Divorce:

  • You and your spouse must come to the Clerk’s Office together and jointly file the paperwork.
  • You will need to bring a form of identification that includes your picture (such as a driver’s license).

For other documents:

  • Most of the forms may be signed in front of a deputy clerk or a notary public. The Family Court Case Management Unit provides free notary service.
  • Once the documents are completed, signed and notarized then you must go to the Family Court Case Management Unit (Family Intake) on the 3rd floor to have paperwork reviewed/approved before filing.
  • If approved, you will be given a pink card stamped approved, and will be instructed to go to the 2nd floor to the Domestic Division (payment is made in cash, master card, cashier’s check or money order only).
  • To have other party served, make 3 sets of copies of the paperwork you are filing and bring them with the original set to the 3rd floor Family Intake Window for review. 2 sets are for the Sheriff and the 3rd copy is for your records. The original set is for the Osceola County Courthouse to keep. If the case involves modifying child support and the Dept. of Revenue (DOR) enforces your case, you will need to make an additional 2 sets of copies (for a total of 5 copies) in order for the DOR to be served. You must also complete a separate summons to be served. Do not make copies if they are not notarized.

 Orange County, Florida

As per the courts website on 10/07/2016, the following is a summary of the filing procedure:

  • Take completed forms to room 330 of the courthouse before 3:30 p.m. to be reviewed and notarized
  • Return to room 320 to file the completed documents
  • Once the case is filed, Family Court Services will contact the petitioner with instructions (usually within 30 days)
  • If no further filing is required, the petitioner will receive a hearing date and time by mail

 Polk County, Florida

As per the courts website on 11/12/016, the following is a summary of the filing procedure:

  • bring your original completed packet along with
  • two copies of the entire packet to the Polk County Clerk of Courts in Bartow, Lakeland Branch, or Winter Haven Branch.
  • Certain forms must be notarized. You may do this prior to filing, or we will be happy to acknowledge/attest to your signature at the time of filing for a fee of $3.50 per document. If you choose to have the clerk attest to your signature, please do not sign the forms ahead of time.
